Terms and Conditions

Good Faith Agreement: All inquiries referred by Sentient Jets to Worth Avenue Yachts shall be handled in good faith, adhering to the terms of this agreement.

Charter Inquiries:

  • Clients referred for charter bookings that result in a retail charter will be entitled to receive 25% of the retail charter commission received by Worth Avenue Yachts.
  • The client will receive a discount equivalent to 25% of the retail charter commission at the time of booking.

Sales Inquiries:

  • Clients referred for sales inquiries will be eligible to receive 10% of the broker’s commission, calculated based on the final purchase price.

Payment: Payments to the referred clients will be made in accordance with the terms of the respective bookings or purchases.

Confidentiality: Worth Avenue Yachts and Sentient Jet Client Referrals shall maintain the confidentiality of all client information and transaction details shared during the referral process.

Limitations: This agreement is subject to any legal or regulatory restrictions that may apply to such referral arrangements.

Amendments: Any amendments or changes to this agreement must be made in writing and agreed upon by both parties.

 

Terms and Conditions Charter 

  • The cost of all wire fees incurred shall be at the cost of the party forwarding monies, excluding any charges or fees relating to the transfer of provisioning monies and fuel delivery fees, if applicable to the Vessel, which shall be at the cost of the Charterer.
  • Smoking or Vaping is not permitted onboard or only in areas designated by the captain.
  • A crew gratuity is not included in the charter fee. 20% is customary for excellent service. Given at the Charterer’s discretion. 
  • Use of personal watercraft is only permitted subject to the operator having the appropriate license and meeting local operating regulations. Any liability from non-compliance is entirely at the operators’ risk.  Additional watersports waiver will be required.
  • No children under the age of 16 shall be allowed to operate personal watercraft unless they hold a current boaters safety license. 
  • The charterer agrees that many water sports and activities such as water skiing, diving, snorkeling, etc., can be physically demanding and the charterer undertakes these activities of their own desire and assumes all risks of injury or death with these activities.
  • Infants and children must be under the supervision of an adult in the charter party at all times.
  • Fishing is available subject to local laws and acquisition of proper permits.  
  • Pets are not permitted on board unless approved by prior arrangement with the owner. 
  • Satellite TV/WiFi where geographically available. Additional costs may apply, please inquire about VSAT packages.
  • It is the responsibility of the Charterer to ensure that he and his guests hold current valid visas and passports for all countries visited during the charter.
  • Guests must agree to not wear shoes on the vessel or may wear clean, white bottom, non-marking deck shoes.
  • Guests agree to respect fabric on upholstered furniture and to take care not to sit on interior furniture with suntan oil or when wet. 
  • Any damage caused by any guest to the yacht and/or yachts equipment or furnishings shall be paid by the charterer and may be withheld from the APA until estimates are available. Charterer’s legal liability Insurance may be purchased for such incidents. 
  • Redelivery at a location other than that specified above will incur extra charges to the Charterer.
  • If there is an accepted sales agreement up to 30 days prior to the commencement of this charter and the new owner does not wish to fulfill the charter agreement an immediate repayment of all funds paid by the charterer will be issued without penalty.
  • All parties acknowledge that under the current COVID 19 situation there are inherent cruising limitations and health risks by traveling and that the Owner, Charterer and Crew will make a good faith effort to adhere to CDC and WHO guidelines but cannot guarantee any of these measures will prevent the potential risk of contracting COVID 19 or related illness.
  • If owner cancels due to reasons other than force majeure he agrees to pay full brokerage and charter marketing commissions unless the charter manager and or charter broker is able to rebook the charterer on another comparable vessel, earning the same commission fee or greater.
  • If Owner cancels due to a force majeure event caused by groundings, major mechanical breakdowns, or electrical breakdowns and the charter manager and or charter broker is unable to rebook the charterer on another comparable vessel earning the same commission fee or greater, then the owner agrees to pay full brokerage commission and discounted Charter marketing fee on the gross charter fee.
  • If Owner cancels due to any other force majeure events such as Pandemic, War etc. as defined in the charter contract then the owner shall not be obligated to pay the brokerage commission or the charter marketing fee.

  • This Agreement will be governed by and construed in accordance with the maritime law of the United States and, to the extent such law fails to supply a rule of decision, the law of the State of Florida regardless of any conflicts-of-law principles that would require the application of any other law. Any dispute arising out of or in connection with this Agreement or any alleged breach hereof will be resolved by binding and confidential arbitration in Fort Lauderdale, Florida, or such other place as the Parties may agree in writing, in accordance with the Rules of the Miami Maritime Arbitration Council (the “MMAC”) current when the arbitration proceedings are commenced.
